We will open an active claim file any time a claim has been made or the PLF incurs expenses related to the claim including review of the claim, repair, investigation, or representation for subpoenaed testimony.
On the other hand, we open a suspense file when we are notified of an act, error, or omission that may result in a future claim against you. You can report suspense incidents to us under Section VII.2. of the Claims Made Plan.
If, after review, we believe the error can be corrected or mitigated, we may attempt to repair the problem to avoid or mitigate a malpractice claim. This is completely discretionary.
If the claim has merit and we do not believe the situation can be repaired or a repair is not practical or a pragmatic course of action, we attempt to negotiate an appropriate settlement.
If the claim lacks merit, we will notify the claimant that we are denying the claim.
If a lawsuit is filed, to the extent the claim is covered by the PLF Claims Made Plan or we otherwise have a duty to defend you, we will hire defense counsel to represent you. We will attempt to consult with you throughout the claim process.
If a suspense file is opened, we will review the incident with you and wait to see if a claim develops. If a claim develops, we will convert the suspense file into a claim file and actively address the claim.
If you have excess coverage with a commercial coverage carrier, it is your responsibility to give notice of a claim or incident to your non-PLF excess carrier, if you determine it is appropriate. This is part of your contract with your excess carrier. (Be aware that prompt notice of all claims is generally required under some excess policies.) It is our general policy that the PLF will not provide first notice of a claim or incident to an excess carrier. Once we know that an excess carrier is involved in the claim, however, we will cooperate with the excess carrier throughout the claim handling process.
Some claims may appear to be so small or non-meritorious that they will clearly fall within your primary PLF coverage, and so you may decide it is not necessary to notify your excess carrier. However, sometimes a claim or incident that appears to be small or insignificant at first later turns out to be much more serious. If you do not report such a claim or suspense incident to your excess carrier when you first know about it, and then try to report it at a later time, you may jeopardize your excess coverage.
For this reason, you should seriously consider reporting all claims and suspense incidents immediately to your excess carrier, even if they appear to be small or non-meritorious. This will usually avoid the possibility of loss of excess coverage for lack of timely reporting.
